1. Acceptance of Terms
By accessing or using the E-Nyasa platform (website and mobile applications), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
2. Description of Service
E-Nyasa provides a marketplace platform connecting buyers and sellers in Malawi, along with logistics services for parcel delivery through our branch network. We facilitate transactions through escrow protection but are not a party to the sale between buyers and sellers.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account and use our services.
4. Marketplace Rules
Sellers must list only products they are authorised to sell. Prohibited items include illegal goods, counterfeit products, hazardous materials, and any items restricted under Malawian law. E-Nyasa reserves the right to remove any listing that violates these rules.
5. Escrow & Payments
All marketplace transactions are processed through escrow. Buyer funds are held securely until delivery is confirmed. A platform fee of 5% is charged on the order subtotal. Transactions exceeding MWK 100,000 may require additional verification. Sellers receive payment upon buyer confirmation of delivery.
6. Delivery & Logistics
E-Nyasa facilitates delivery through our branch network. Delivery times are estimates and not guarantees. Parcels must be collected within 7 days of arrival at the destination branch. Uncollected parcels may be returned to the sender.
7. Limitation of Liability
E-Nyasa acts as a platform facilitator. We are not liable for the quality, safety, or legality of items listed by sellers. We are not liable for any loss arising from transactions between buyers and sellers, except where escrow protection applies. Our total liability shall not exceed the platform fees collected on the relevant transaction.
8. Termination
E-Nyasa may suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any behaviour that harms the platform or its users. You may close your account at any time by contacting support, provided all pending transactions are settled.
9. Changes to Terms
We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. We will notify users of significant changes via email or in-app notification.
10. Governing Law
These terms are governed by the laws of the Republic of Malawi. Any disputes shall be resolved in the courts of Malawi.
